Terms and Conditions of Sale
**PREAMBLE**
These General Terms and Conditions of Sale (the “Terms”) govern all purchases of unclaimed parcels made from the company MASTER COLIS, a simplified joint-stock company with a capital of €1,000, registered with the Angoulême Trade and Companies Register under number 944 705 789, with its registered office at 23 IMPASSE LEROY, 16000 ANGOULEME (hereinafter the “Seller”), either directly in physical locations during pop-up store events (hereinafter the “Store”), or on the website www.mastercolis.com (hereinafter the “Website”) operated by the Seller.
ARTICLE 1 – PURPOSE
These Terms are entered into between the Seller and any non-commercial individual (“You”) wishing to make a purchase either in the Store or on the Website.
You must be at least eighteen years old to make a valid purchase in the Store or on the Website.
By making a purchase from the Seller, you acknowledge that you have read and unconditionally accept these Terms.
ARTICLE 2 – PRODUCTS
The products governed by these Terms are those offered for sale by the Seller in the Store or on the Website (the “Products”), subject to availability.
The Products are unclaimed parcels sold by the Seller in their original sealed condition. They are sold by weight. The Seller has no knowledge of their contents, and you expressly accept that the contents may not meet your expectations, without liability on the part of the Seller.
ARTICLE 3 – PRICES
The prices of the Products are shown in Euros, including all taxes. They include VAT and any applicable discounts at the time of the order.
Prices are solely determined based on the weight of the parcels and not the potential value of their unknown contents.
For purchases made on the Website, Product prices do not include delivery fees. Delivery charges will be specified before the order is finalized.
If any taxes or contributions, including environmental ones, are introduced or modified, such changes may affect the sales price of Products listed on the Website or other sales channels.
However, once your order has been confirmed, the price will not be altered.
ARTICLE 4 – ORDERS ON THE WEBSITE
You can place your order online via the Website.
Once your cart is confirmed, you will be asked to provide your email address, shipping address, select a delivery method, choose your payment method, and accept these Terms by checking the designated box—this final step forms the sales contract with the Seller.
Any order implies acceptance of the prices and descriptions of the Products available for sale.
The Seller will confirm your order by email and attach a copy of these Terms in PDF format.
In case a Product is unavailable, you will be notified by email.
For any questions regarding your order, you can contact the Seller’s customer service via the Website.
ARTICLE 5 – PAYMENT METHODS ON THE WEBSITE
You may pay for your order on the Website using:
Bank cards: Carte Bleue, Visa, Mastercard.
Payments by credit card are debited at the time of the order.
ARTICLE 6 – DELIVERY OF PRODUCTS ORDERED ON THE WEBSITE
At the time of ordering on the Website, the Seller may offer different delivery methods based on the Product’s size and your shipping address.
Products can be delivered within mainland France and abroad.
Delivery times depend on the chosen delivery method and the shipping location. They are provided for information purposes only during the order.
ARTICLE 7 – RIGHT OF WITHDRAWAL
7.1. No Right of Withdrawal for In-Store Purchases
Please note that there is no right of withdrawal for purchases made directly in-store. No products will be returned or exchanged by the Seller.
7.2. Limited Right of Withdrawal for Online Purchases
For distance purchases made on the Website, you generally have a legal right of withdrawal for fourteen (14) calendar days from the date of receipt of your entire order.
However, due to the nature of unclaimed parcel sales and the uncertainty regarding their contents, this right applies only if the parcel remains unopened.
Provided the parcel remains unopened, you may return it within the 14-day period without providing any reason or paying penalties. Return shipping costs are your responsibility.
To exercise your right of withdrawal, you may use the withdrawal form attached in Appendix 1 or send an unambiguous written request, including through your customer account under the “Returns” section.
The Seller will acknowledge receipt of your withdrawal request by email.
You must then return the unopened Products within fourteen (14) days from your notice of withdrawal, to the address provided by the Seller.
The Seller commits to refunding the full amount paid, including initial delivery charges, upon receipt of the returned unopened Product.
If you only return part of your order, the initial delivery charges will not be refunded.
Refunds will be issued using the same payment method as used during the order.
Please note: If the Product has been opened, no returns or refunds will be accepted by the Seller.
ARTICLE 8 – LEGAL GUARANTEES
Due to the nature of selling unclaimed parcels, the Seller has no knowledge of the contents and therefore these contents do not benefit from the legal guarantees of conformity (Articles L. 217-1 et seq. of the French Consumer Code) or hidden defects (Articles 1641 et seq. of the French Civil Code), which you expressly acknowledge and accept.
The Seller’s warranty is strictly limited to the accuracy of the stated weight of the Product, with a permissible deviation of ±200 grams not considered a defect.
This guarantee applies only if the Product remains unopened.
You have a two-year period from the date of delivery to claim under the legal warranty of conformity, potentially requesting replacement or a price reduction or cancellation, as provided by law.
ARTICLE 9 – TRANSFER OF RISK
Risk related to the Products transfers to you upon delivery.
This transfer occurs when you take possession of the Products in the Store or upon delivery in the case of an online purchase.
You expressly accept the risk inherent in the unknown contents of the purchased Products.
ARTICLE 10 – LIABILITY
Given the unknown nature of the Products, the Seller shall not be held liable for any direct or indirect damages arising from the contents, including if they are illegal under applicable laws (e.g., prohibited or counterfeit items).
You agree to dispose of any illegal contents at your own expense and indemnify the Seller from third-party claims.
The Seller is not liable in cases of unforeseeable third-party acts or force majeure.
Additionally, the Seller shall not be held liable for problems related to Internet use (e.g., service interruptions, external intrusions, viruses).
ARTICLE 11 – PERSONAL DATA
When you purchase either in-store or online, the Seller may collect personal data (e.g., email, name, address, phone number, payment details).
This data is processed for:
Recording your acceptance of the Terms,
Managing your order on the Website,
Providing customer service.
Data may be securely shared with subcontractors (e.g., delivery partners) as needed.
Appropriate technical and organizational measures are implemented to safeguard the data.
The retention period depends on the purpose of collection and applicable law.
In accordance with the General Data Protection Regulation (GDPR) and French law, you have rights of access, rectification, objection, deletion, portability, and limitation. You can also set directives for post-mortem data management.
To exercise your rights, contact the Seller by post or email at contact.mastercolis@gmail.com.
If needed, you may file a complaint with the CNIL: www.cnil.fr.
ARTICLE 12 – CONSUMER MEDIATION
In accordance with European Directive 2013/11/EU and applicable French law, the Seller provides access to free consumer dispute mediation through a designated body (available upon request).
You may use mediation only after first contacting the Seller in writing and receiving no satisfactory reply within two months, and provided the claim is not abusive or already handled by another mediator or court.
You have one year from the written complaint to initiate mediation.
The European Commission also offers an online dispute resolution platform at: www.ec.europa.eu/consumers/odr
ARTICLE 13 – APPLICABLE LAW AND JURISDICTION
These Terms are governed by French law.
In case of dispute, the competent court will be that of the defendant’s place of residence or, at the claimant’s choice, the place of effective delivery of the Product.
